By accessing or using the services provided by Sweetunes at sweetunes.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  - Use the Service in any way that violates any applicable law or regulation

  - Use the Service to transmit any harmful, threatening, abusive, or otherwise objectionable material

  - Use the Service to infringe upon the rights of others

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Sweetunes. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

User Content

You retain ownership of any content you submit to or through the Service. By submitting content, you grant Sweetunes a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with operating the Service.

Payments and Billing

Certain aspects of the Service may require payment. You agree to provide accurate billing information. All payments are non-refundable unless otherwise stated. We reserve the right to change our pricing at any time with reasonable notice.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

In no event shall Sweetunes, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  - Any conduct or content of any third party on the Service

  - Any content obtained from the Service

  - Unauthorized access, use, or alteration of your transmissions or content

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Governing Law (EU Users)

For users in the European Union, these Terms shall be governed by and construed in accordance with applicable EU laws. Nothing in these Terms shall affect your statutory rights as a consumer under applicable EU consumer protection legislation.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

When a copyright holder (if you submit any material to us you acknowledge that you are in fact the copyright holder/claimant and/or that you have full legal authority to submit it to us for the purposes of this agreement) or artist of an unpublished song submits their music to us they agree that it grants to us an irrevocable, perpetual, non-exclusive, transferable, royalty free, license throughout the universe, granting us the use of both the performance and recording rights and privileges to use the material as we may deem fit.

We only use music that has been submitted to us, or has a non-commercial copyright, or is within the public domain by choice of the artist.

Any music not submitted directly to us we always search for a copyright before use via

• https://publicrecords.copyright.gov/ by both the artist name as a keyword and the song title
• VLC Media Player audio finger print scan and search technology

If you are the artist and do not want us to use your material, regardless of any of the previously mentioned information, if you contact us we will most likely choose to cease use of said material (though we retain the right to decline if we have the legal authority to do so). Contact us at sweetunes@proton.me and verify you are the artist so we can cease use and delete it from our systems. We generally have zero desire to promote any artists that do not want us promoting them nor if they do not believe in the principles of our mission statement.

We DO NOT use nor condone the use of AI within any tracks to create lyrics, beats, synthesis instruments or voices. If you submit a track to us with any of these features you acknowledge the loss of all rights and privileges to our site, content, memberships, etc. In addition, in failure to disclose ANY use of AI you also acknowledge this will result in damages and compensation by you to Sweetunes in an amount no less than $100,000 USD plus legal fees and the amount may be greater accordance with the amount of any and all damage to the brand, owner and/or employees by means of (but not limited to) loss in profit and/or loss in reputation.
